: M.J. Hamatschek, M.S. Richter and K.-P. Dahle declare that they have no competing interests. One of the coauthors, K.-P. Dahle, is a member of the FPPK’s editorial board.
: All studies whose data were used were approved by the German Psychological Association’s (DGPs) research ethics board with respect to the professional ethical guidelines formulated by DGPs and BDP (German Association of Psychologists). The research procedure was reviewed and authorized by the Berlin Ministry of Justice. Due to the retrospective study design, it was not possible to obtain the subjects’ consent on the assessment of their records or on their inclusion in the publication. Therefore, for each study to be authorized, a comprehensive data security policy was developed to which all participating researchers pledged adherence in written form. Complete pseudonymization was guaranteed while ensuring reassignability of reconviction data collected at a later time. Conformity with the then-applicable German and European data privacy law was attested by the Berlin Commissioner for Data Protection and Freedom of Information. As for the complementary re-assessment of some file material (verdicts) that was necessary for this study, sensible information was blackened prior to coding. Moreover, coders signed a confidentiality agreement in which they were referred to the applicable professional discretion regulations (specifically, § 203 StGB and § 10 NDSGAQ3).
